    GENERAL TERMS AND CONDITIONS - ZOURIO

    Article 1 - Definitions

    In these conditions, the following terms shall have the following meanings:

    • Cooling-off period: the period within which the consumer can make use of their right of withdrawal.

    • Consumer: the natural person who does not act for purposes relating to their trade, business, craft, or profession and enters into a distance contract with the entrepreneur.

    • Day: calendar day.

    • Continuing performance contract: a contract covering the regular delivery of goods, services, or digital content during a certain period.

    • Durable medium: any tool that enables the consumer or entrepreneur to store information that is addressed to them personally in a way that makes future consultation and unaltered reproduction of the stored information possible.

    • Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period.

    • Entrepreneur: the natural or legal person who offers products and/or services to consumers remotely, in this case, Zourio.

    • Distance contract: an agreement concluded between the entrepreneur and the consumer as part of an organized system for distance selling of products, digital content, and/or services, whereby exclusive use is made of one or more means of distance communication up to and including the conclusion of the agreement.

    • Means of distance communication: means that can be used for concluding an agreement without the consumer and entrepreneur being in the same place at the same time.

    • General Terms and Conditions: these General Terms and Conditions of Zourio.

    Article 3 - Applicability

    These general terms and conditions apply to every offer from Zourio and to every distance contract concluded between Zourio and the consumer. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated that the general terms and conditions are available for inspection at Zourio and will be sent free of charge upon request.

    If the distance contract is concluded electronically, these general terms and conditions may be provided electronically in such a way that they can be easily stored by the consumer on a durable medium.

    In the event that specific product or service conditions apply in addition to these general terms and conditions, the consumer may always invoke the applicable provision that is most favorable to them in case of conflicting terms.

    Article 4 - The Offer

    • If an offer has a limited validity period or is subject to conditions, this shall be explicitly stated.

    • The offer is non-binding. Zourio is entitled to change and adjust the offer.

    • The offer contains a complete and accurate description of the products and/or services offered. Images used by Zourio are a true representation of the offered products.

    • Obvious mistakes or errors in the offer shall not bind Zourio.

    • Prices stated do not include customs clearance costs and import taxes. These costs shall be borne by the customer.

    Article 5 - The Agreement

    • The agreement is concluded when the consumer accepts the offer and meets the stated conditions.

    • If the consumer accepts the offer electronically, Zourio shall immediately confirm receipt of acceptance electronically.

    • If Zourio has valid reasons to refuse an order, they are entitled to do so.

    Article 6 - Right of Withdrawal

    • Consumers have 14 days to withdraw from the agreement without providing reasons.

    • During the cooling-off period, consumers must handle the product and packaging with care.

    • If the consumer wishes to withdraw, they must notify Zourio in writing or via email within 14 days of receipt.

    Article 7 - Costs in Case of Withdrawal

    • The consumer bears the cost of returning the products.

    • Refunds will be processed within 14 days after withdrawal, provided the product is returned in its original condition.

    Article 8 - Exclusion of the Right of Withdrawal

    The right of withdrawal is excluded for:

    • Products made to the consumer’s specifications.

    • Products that cannot be returned due to hygiene reasons (e.g., undergarments).

    • Digital content that has already been accessed.

    Article 9 - The Price

    • Prices are subject to change due to fluctuations in tax rates and market conditions.

    • Typographical errors are not binding for Zourio.

    Article 10 - Conformity and Warranty

    • Products must meet reasonable usability and quality expectations.

    • Warranty does not apply to damage caused by misuse or unauthorized modifications.

    Article 11 - Delivery and Execution

    • Zourio aims to fulfill orders within 30 days unless agreed otherwise.

    • If an order is delayed, the consumer will be informed within 30 days.

    • The risk of damage/loss transfers to the consumer upon delivery.

    Article 12 - Duration and Termination of Agreements

    • Consumers may terminate indefinite agreements with a maximum notice period of one month.

    • Fixed-term agreements may be terminated at the end of their duration.

    Article 13 - Payment

    • Payment must be completed within 7 working days after the start of the cooling-off period.

    • Inaccuracies in payment details must be reported immediately.

    Article 14 - Complaints Procedure

    • Complaints must be submitted within 7 days of discovery of defects.

    • Zourio will respond to complaints within 14 days.

    • If a complaint cannot be resolved, it may be referred to a dispute resolution body.

    Article 15 - Disputes

    • These general terms and conditions are governed by U.S. law.
